Oh my goodness, this is a tricky one!!!
Legally even if a product is given away you still need to apply for a license from MCPS, in the case of a DVD strangely enough it is called a DVD1. Then a percentage is levied on the perceived value (in the case of a freebie) which gets distributed via the network of publishers etc. Even with our own products on our own label we have to go through the same loop, eventually receiving back most of the money we sent off in the first place!
Nearly all ATF songs are published by IQ Music Ltd and that contract will remain in place for the forseeable future. Our new song(s) and Rob's songs are currently unpublished therefore, with permission, they can be distributed privately without having to pay MCPS.
Practically I personally think this is a great way of lifting interest in the band and if we were nor published then I would have no objection. However, I would not want to encourage anyone to technically break the law or upset the excellent relationship both Andy P and I have with IQ Music therefore it's a no I'm afraid.
Regardless I do hope that clarifies the situation??!!
